A student-focused guide to case law analysis

This book is designed to assist and guide students through their studies of elementary contract law in an undergraduate or Juris Doctor degree. It is intended to follow and complement a series of classes that discuss the key principles and cases in contract law.

This book covers the topics of Agreement, Certainty, Consideration, Intention, Formalities, Estoppel, Express and Implied Terms, Construction, Exclusion Clauses, Privity, Discharge by Performance, Breach and Frustration, Termination, Damages and Vitiating Factors.

As one of the first substantive law topics students undertake, the skill that contract law units seek to develop is case law analysis. This book focuses on that skill and is designed to help students read cases and extract key principles to be applied in problem questions or critical analysis by highlighting the kinds of questions they need to ask when reading legal sources. It will help students to appreciate the level of detail that is necessary to engage in when studying cases in order to use a case to resolve legal problems.

This book interacts with Jade, one of the leading professional legal research platforms, to allow students to directly access the major Australian cases in contract law and further develop their research skills by using that platform.

  • Covers Agreement, Certainty, Consideration, Intention and Formalities
  • Builds case-law analysis skills for problem questions and critical analysis
  • Interacts with Jade for direct access to the major Australian cases
